Terms for MemoryRevive digital photograph restoration
These terms explain the service, customer responsibilities, ordering, delivery, restoration limits and available remedies.
1. About MemoryRevive
MemoryRevive is a United Kingdom-based service that supplies personalised digital restoration of customer-provided photographs. Orders are one-off purchases delivered as digital files; there is no subscription and no physical product unless a product description expressly says otherwise. 2. These terms and the contract
These terms, the option description, the price and information shown at checkout form the agreement for an order. If they conflict, the specific description and price shown at checkout for that order take priority. A contract is formed when payment is accepted and MemoryRevive sends or displays confirmation that the order has been received for restoration.
MemoryRevive may reject or cancel an order before fulfilment if the upload is unsupported, unlawful, unsafe, outside the chosen restoration option or cannot be processed reliably. If payment has been captured and no service is supplied, an appropriate refund will be made.
3. What you are buying
The service creates digital files from the photographs you submit. Depending on the chosen option, these can include smaller copies for email and sharing, high-quality copies for printing, before-and-after comparisons, versions with colour added, one download containing all files and personalised memory cards. The option description states the number of photographs and included files. The service does not repair the physical photograph.
Work begins only after payment is accepted. It can continue after you close the website. The private order page shows progress, available downloads and when access ends.
4. Your responsibilities
- Provide a supported file that is within the displayed size, dimension and quantity limits.
- Choose a restoration option that matches the number of photographs and finished files you need.
- Provide an email address you can access and check the order details before payment.
- Confirm truthfully that you own the relevant rights, have permission or have another lawful basis to submit each image.
- Respect the privacy and dignity of living people shown and obtain any authority the law requires.
- Do not upload illegal, exploitative, deceptive, malicious or rights-infringing content.
- Keep the private order link safe and download finished files before the stated expiry date.
The full rules are in Image Rights and Acceptable Use. You are responsible for the accuracy and lawfulness of titles, dates and messages supplied for memory cards.
5. Limits of restoration and added colour
Digital restoration is interpretive. Results depend on the resolution, focus, contrast, damage and remaining detail in the source. Scratches, folds, fading, blur and lost areas may not be fully recoverable. A model can make plausible choices but cannot know exact missing faces, text, objects, clothing, backgrounds or colours.
MemoryRevive aims to preserve identity, apparent age, expression, pose, clothing, setting and composition without beautifying or modernising the scene. Automated output can nevertheless contain errors. Colourisation is an informed interpretation unless reliable colour references are supplied. Outputs are not forensic evidence, identity verification or a guaranteed historical record.
6. Prices and payment
Prices are in pounds sterling unless checkout clearly states otherwise. Checkout shows the final price, any applicable tax and available payment methods before you place the order. Payment is handled by Stripe through the website’s payment system; MemoryRevive’s custom code does not receive full card details.
7. Delivery, access and deletion
When required files are ready, MemoryRevive sends a delivery message to the checkout email address. Delivery is complete when the protected downloads are made available, but you should review and save them promptly. Email filtering, an incorrect address or a customer’s failure to check messages does not extend access automatically.
Your private order page shows when photograph files will be deleted, normally 30 days after completion. You can ask for earlier deletion where that option is available. Once deletion has completed, MemoryRevive may be unable to recreate the files without a new order and a new upload.
8. Review, faults and support
Review the downloads promptly. If an included file is missing or corrupt, or the output materially fails the restoration-option description, contact hello@jamestodd.digital with the order number and a clear description. Do not email the private photograph unless a secure route is provided.
Depending on the problem, MemoryRevive may rerun the work, replace files, make a proportionate price reduction or provide an appropriate refund. A preference for a different plausible colour or an inability to recover information absent from the source is not automatically a fault. Nothing in these terms limits the right to services performed with reasonable care and skill or any other mandatory consumer remedy.
9. Cancellation and refunds
Contact MemoryRevive promptly if you want to cancel. Personalised digital processing may begin soon after payment, but that fact alone does not remove a statutory cancellation right. Any right can be affected only where the legal conditions—including any required information, express request or acknowledgement—have been satisfied. The Refund and Cancellation Policy explains failed, delayed, partial and completed orders. Mandatory consumer rights always take priority.
10. Rights in originals and outputs
You retain your rights in the original photograph. You give MemoryRevive and its necessary service providers a limited permission to copy, process and store it only to validate the upload, fulfil the order, provide support, protect the service and meet legal duties.
As between you and MemoryRevive, you may use the delivered output for any lawful purpose consistent with the rights in the original and the people shown. MemoryRevive transfers to you any rights it may hold in the custom output, but cannot guarantee that an automated output qualifies for copyright protection or is free of third-party rights. No customer photograph will be used publicly without separate written permission.
11. Service availability and liability
Maintenance, provider outages, safety checks or unusual source files can delay processing. MemoryRevive will take reasonable steps to restore service, protect private files and explain a material delay. Nothing excludes liability or remedies that cannot lawfully be excluded, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or mandatory consumer rights.
The service is intended for personal restoration and keepsake use, not forensic, medical, identity, evidence or other high-stakes decisions. MemoryRevive is not responsible for loss caused by presenting an interpretive output as an exact or independently verified record when that limitation has been made clear.
12. Complaints, applicable law and changes
Please email hello@jamestodd.digital first so the issue can be investigated. These terms are interpreted under the law applicable to the contract. If you are a consumer, mandatory protections and any right to bring proceedings in the courts available where you live are not restricted.
The terms applying to an order are those available when it is placed, unless a change is required by law or agreed with you. The effective date above identifies the current public version.
